Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your access to and use of Smooth Social (the “Service”), operated by OLBE Creative Consultant (“we”, “us”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
2. The Service
Smooth Social helps you draft, preview, schedule, and publish social content and manage related engagement via connected third-party networks. Features depend on your plan and on the availability of those networks and our providers.
3. Eligibility
You must be at least 16 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
4. Accounts
You are responsible for your login credentials and for activity under your account. Provide accurate information and keep it up to date. Notify us promptly at support@smooth.social if you suspect unauthorized access.
5. Plans, billing, and cancellation
- Paid plans are billed in advance via Stripe according to the plan you select. Prices are shown in the product and may change with notice for future periods.
- You may cancel in the billing settings; access continues until the end of the current paid period unless otherwise stated.
- Free browsing may be offered with limited features (for example no publishing). Limits are described in-product.
- Except where required by law, fees are non-refundable once a billing period has started.
6. Your content and social accounts
You retain ownership of content you submit. You grant us a limited license to host, process, transmit, and display that content solely to operate the Service (including via our processors such as Outstand and the social networks you connect).
You remain responsible for your social accounts and must comply with each network’s terms and policies. Connecting an account authorizes us (and our processors) to act on your behalf as needed to provide the features you use (publish, sync comments, fetch metrics, etc.).
7. Acceptable use
You agree not to:
- Violate law or third-party rights (including platform terms)
- Spam, scrape, or abuse the Service or connected networks
- Upload malware or attempt to disrupt or reverse engineer the Service
- Misrepresent your identity or affiliation in a harmful way
- Use the Service to publish unlawful, harassing, or infringing content
We may suspend or terminate accounts that breach these Terms.
8. Third-party services
The Service depends on third parties (for example Supabase, Stripe, Resend, Outstand, hosting providers, and social networks). Their availability and policies are outside our control. We are not liable for outages or changes on those platforms.
9. Intellectual property
The Service, branding, and software (excluding your content) are owned by us or our licensors. You may not copy or redistribute them except as allowed by these Terms.
10. Disclaimer
The Service is provided “as is” to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation, or that scheduled posts will always publish exactly as requested when networks or processors fail.
11. Limitation of liability
To the maximum extent permitted by Dutch law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability arising from the Service in any twelve-month period is limited to the fees you paid us for the Service in that period (or €50 if you paid nothing).
Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach, risk, non-payment, or discontinuation of the Service. Provisions that by nature should survive (including IP, liability limits, and governing law) will survive termination.
13. Changes
We may update these Terms. Material changes will be indicated by updating the “Last updated” date (and where appropriate by notice in-product or by email). Continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the Netherlands. Courts of the Netherlands have jurisdiction, without prejudice to mandatory consumer protections that may apply.
